Within inheritance law, a disclaimer of interest is an endeavour by a person to renounce their legal right to benefit from an inheritance. The result of this is that next level of beneficiaries will inherit.
Reasons to Disclaim interests:
A person may choose to disclaim interests for a number of reasons such as:
- The income tax burden on the beneficiary is too high for them
- They are in a lot of debt and the proceeds would be passed on to their creditors.
A disclaimer of interest is usually filed within nine months of the person’s death and should always be in writing. It should also be field before the beneficiary has received any merit from the asset that was left for them. It is important to note that a disclaimer of interest is irrevocable, It must be completely finished and not a partial disclaimer.
